The 2018 Farm Bill has made an interesting string of events occur, creating a mass of flux of new products in the market. Products rich in hemp-derived CBD, Delta 8 THC, Delta 10, and HHC have flooded the market and now manufacturers are coming out with what? Hemp-derived Delta 9 THC. How so? And how is this legal?

Hemp is a member of the cannabis family and while less potent than its cousin, Mary Jane it still contains a spectrum of cannabinoids that we are still discovering at this point. What we find frustrating as a company is the number of manufacturers solely interested in creating heavy THC based products. From what we see and hear, we have evidence to believe that is not what is best for our bodies. Isolating cannabinoids only dilutes the effectiveness of products.

Of course, there are situations where you must isolate the cannabinoid; for example, a truck driver should not be using any other product other than isolated CBD or a Broad Spectrum product where there is zero THC.

These new THC products you see on the market are a direct result of the flexibility in The Agricultural Improvement Act of 2018, more commonly known as the Farm Bill.

How Is Hemp-Derived Delta 9 THC Legal?

That Farm bill we referenced above gave a big green light to hemp-derived products that contain less than 0.3% THC on a dry weight basis. This language allows for hemp-derived delta 9 THC products to flourish.

For example, if you have an edible that weighs 100grams (again if we refer back to the Farm Bill, only 0.3% of that edible’s dry weight can consist of THC). Using this exact math manufacturers are technically allowed to pack 300mg of THC derived from hemp into that edible and it is still legal.

Is this a Gray Area for Delta 9 THC or Legal Innovation?

In our eyes it’s both. We want to see a marketplace where cannabis innovation isn’t stifled by our laws. A place where hemp and marijuana companies work together to deliver patients the best therapeutic results. That’s what our nation needs, more unregulated cannabinoid therapy.

If our governing bodies will not allow, it appears we have found our own way. See edible example above.

We Want More Delta 9 THC & Additional Cannabinoids

We see customers day in and day out and we have yet to see an individual who does well on THC alone or hyper-concentrated doses of THC. Typically, those doses are reserved for severe quality of life circumstances. Cannabinoid Research & Legalization Needs to Continue

Unfortunately, most of the research to date is an accurate representation of the marketplace. The University of Mississippi has held the sole federal contract for growing marijuana – for research purposes only – since 1968. This means all of the cannabis that has been studied has come from the University of Mississippi. The innovation in the cannabis industry is booming! We literally have new cultivars every single day! No offense, but there is just no way the horticulturists at University of Mississippi are keeping up with the innovation at the same rate.

Bottom line, Federal legalization needs to occur in order for academia to align with the innovation in the industry. Until that does, the black market will continue to inflate, legal companies will continue to try to compete and the end products will not necessarily be what is in fact best for our brain’s and bodies.
